LOL..you can't indict the poor bird by mere circumstantial evidence alone..i saw from your pier that there are hundreds of probable suspects..

Paul..the presumption is innocent til proven guilty..hehe..

fresh, steamy, 1cm fr birds backside - all circumstantial, plenty of birds in the pier (refer to Ian's thread)
only bird around - can be cropped version
human photographer witness - the photographer is biased (on record in his pier thread - gulls give him the willies....)
picture of the scene - with this time and age, photos are not the best evidence as they can be manipulated..

..plenty of reasonable doubt in there.. (haha..just kidding Ian..nice capture..)
