I don't find the tree to be that distracting I would however crop it out since it adds nothing to the scene and it's small. I would also straighten the horizon as well. I think the sun and sky looks just fine. I however thing getting just a little bit lower will introduce a more focused subject for the foreground (the rapeseed field).
Thank you for sharing nice first HDR attempt not over done. Just crop out that halo around that tree on the right of the frame

It very well may be straight, just doesn't appear straight. Maybe getting higher would help so the viewer would notice the filed is a rolling hill?
