Is there some thing that I am missing ???

Camera: Canon EOS 50D
Exposure: 0.004 sec (1/250)
Aperture: f/8.0
Focal Length: 60 mm
ISO Speed: 200
All comments are always welcome and any help to improve.Here to learn and help if I can.

If you could be more specific we could offer some solicited feedback. In the meantime, I can offer some unsolicited feedback based on my own impressions. My initial reaction when I saw the image was, "what a gorgeous scene! I wish I could see more of it!" If you have a version that captures the entire tree I think it would look really impressive. Right now, it's too close to the subject. I think a wider angle would suit this image very well.

Am I to close if I pull back some then the sky is shot what can I do to avoid this kind of thing

Definitely too close. Nothing wrong with having the sky in your image. I imagine you might be concerned with having too much overexposed sky in the image, but I don't think that is a problem for this image. Right now, you have a gorgeous scene that CAN'T be seen because it's too close up to the subject. Kind of like taking a photo of Jessica Biel's nose.

As has previously been mentioned, more of the scene would have been nice! The photo as it is, does capture the icy crispness of winter - a perfect subject!
