At first I was a little lost.... The relevant part to a photographer getting hosed is part 2

That said, I think the decision for the photographer was technically wrong and because of the "suspected" plot between the plaintiffs. She can get away with that because when they do the show you sign an agreement to accept whatever the Judge says without recourse.

Everyone *should* already know that commercial use without a release is not legal in USA.

Not really, just misinformed (and thick)....He figured he was in the clear because he hired someone else to do the work and it's thier work....Just like thinking hiring an accountant to do your taxes means you won't be liable if there's an error.
