Default Photographing without consent

Where does an individual stand in this horribly pc world when they photograph someone without consent. ie. people are watching a street entertainer and you shoot them because of their interaction with what they are watching or maybe you see an interesting individual in the street worth taking a few snaps of...

It's a free market, they are outside.... no right to privacy. Snap away. T.S. for them if they get mad.

At least in the US.

Depends: where are you and where are they standing.

By "street performer" Im going to assume out, in public. Maybe downtown, or a market area.

The general rule is that if youre in a public place (not to be confused with public LAND) then youre good to go for just about anything photography wise - regardless of what the people in your picture may some day tell you.

The laws arent that strict on what you can and cant do when you take the pictures. They are, however, a bit more limiting when it comes to what you can and cant do with the pictures afterwards.

Check with a good lawyer, or your local bylaws.

It gives precise information what you can and cannot take photos of.

I am certain there would be a similar law (and web site) for UK.

I remember I was in Scotland a decade ago and took a picture of a Bagpipe player. I was chased a good half mile by him. He said that I needed to "donate" to him to take his picture.

If they are in a public place I'll take a picture of them. Anyone in public is fair game. A photographer can also take pictures of people in their yards so as long as they are standing on a public sidewalk or in the street. As for street or market entertainers, they are also trying to make a living, so I drop a buck (1 USD) in the hat.

What you can't do is use that person's picture to promote your business or a product without their permission. You need a model release for that.

For editorial purposes you don't need a model release! For commercial, such as advertising you need a model released signed.
