Default Unauthorised use of photos on facebook

This has prob done the rounds but whats the potential liability for someone using a photo taken from say my facebook photo albums as
1) their facebook photo profile
2) used outside facebook for a) none commercial use b) commercial use?

is the usual course of action

a) ask them to remove
b) suggest that legal action might be taken...

did this happen to you?

is the photo of them?

are you friends with the person who swiped your photo? (and I don't mean Facebook friends, but are you friends in real life)

are they a paying client that you did a photoshoot for?

are they just somebody completely random and claiming the photo as their own?

haha, sorry for all the questions but it might help you get a better answer

Whatever it is, grab screenshots of it before talking to them. It'll help if they want to get uppity about it, and you have to sue for copyright infringement.

In addition to Katia's questions, if you live in the US, did you register the images with the copyright office?

Watermark them and let them go nuts.....

Thank them for the free advertising and sleep better at night.....



I should add that this is only personal.... commercial use is totally different....
