New Twitpic partnership

I haven't seen this mentioned on the board, and wondered what your thoughts are about it.

"TwitPic is claiming a "worldwide, non-exclusive, royalty-free, sublicenseable and transferable license" on all images uploaded to the service, as the firm signs a deal with celebrity photo agency WENN."

You know what my favorite piece of trickery in the Twitpic ToS is? it's that even if you delete your images, they can still use them for an undefined amount of time and they can store the images forever.

... The above licenses granted by you in media Content you submit to the Service terminate within a commercially reasonable time after you remove or delete your media from the Service provided that any sub-license by Twitpic to use, reproduce or distribute the Content prior to such termination may be perpetual and irrevocable.

You understand and agree, however, that Twitpic may retain, but not display, distribute, or perform, server copies of your media that have been removed or deleted. The above licenses granted by you in user comments you submit are perpetual and irrevocable. Deleted images are only accessed in the event of a legal issue.

So in simple terms, does this mean that the original owner retains the copyright, but Twitpic can distribute new or historical images, uploaded to Twitpic, to any of their partners for any usage without any financial recompence to the original owner?

I suspect Twit pic won't be touched with a barge pole, by anyone with any concern over copy righting of their images, if the above is the case.

In contrast, twitpic’s terms of service grant twitpic extremely broad rights to license, sublicense and otherwise use uploaded images, whether for commercial purposes or not and whether compensated or not, without any obligation to pay anything to the content owners. Further, twitpic imposes a requirement on users that they indemnify and hold harmless twitpic, its officers and employees, against any claims arising out of the use of any content posted on twitpic.

So if you post a pic, they can alter it, use it for advertising, and when the un-released model sues, you have to pay any award.
