situation for release forms??

I like to shoot live bands .. so alot of time I get requests from the band to shoot the crown or even from patrons .. and usually I'll shoot them and give them my card with email, and ask them to email me and I'll send them photo .. I've even gotten a couple paying gigs from this ..

my question .. If I'm in a public place ie bar, park etc .. and shoot someone candidly.. can I use their photo in my portfolio without a release form??

It depends, it's not the taking of the photo, its the use.

Have a read of this, (especially point 2) the finer details would change from country to country but in general they will be similar.
