Brush legalities

Q: What, do you suppose are the legal issues in using "brushes" that people have created and posted on a website with the intent of letting people download and use them in creating digital art?

If they let you download them, then its freeware. I've got a lot of brushes that way, and actions too.

It depends though. For example, Obsidian Dawn has a set of Terms of Use and asks you to purchase a license if you're going to use the brushes for commercial work. I consider brushes like any other piece of artwork. Some people are happy to let you use them without credit, some use something very similar to a Creative Commons License, and I'm sure there are other ones out there that you have to buy.

I think posting brushes on a website for people to use is the artistic equivalent of leaving your old sofa out by the road; you have placed it in the public domain and fully expect others to take advantage of it. The courts are not going to allow people to do that and then come back later and try to demand compensation.

I understand what your saying but don't totally agree. Many things that you can download for free have licenses that can restrict their usage such as Creative Commons, GPL etc.

If they do not up front say to buy a license/limit your use you're free to go. However that may not hold up in court...
Read the fine print though, if there is any.
