Default Exclusive rights pricing?

I had someone contact me to get a license for a photo I have on flickr. I consulted with a couple friends and they said to shoot for $250 for the image with a referral and $350 without. The image would be used for the lifetime of the website, and possibly in print material.
They said that was reasonable, but would like to know what it would take to get an exclusive rights on the image.

I honestly have no clue what would be appropriate in this case. Anyone give me some guidance on this sort of pricing?

Phil, that's too nice a shot to give lifetime rights for only $250.00. A year maybe, but not lifetime. Contact the local ASMP Chapter (American Society of Media Photographers) and talk to them first.

You could sell one large framed print of that image for $250. Ask for WAY more than that!

I'd do $350 with referral, $550 without for a few years.

Thanks for the input... funny thing is, it was an accidental photo taken with a p+s before I got more serious about photography.
I haven't really sold too much, so any money back in is a positive thing so far. (mostly done charity sales)

Thanks... just no clue about pricing. Trying to figure out who this site is for now. If they have money to throw at the solution, want to know who they are as well.

I would be careful considering "Exclusive" .vs. "Unlimited" use.
Unlimited would allow them to use it however they want.
Exclusive means you give up *your* rights to use the image as well.

If they really want Exclusive, they'd better be ready to pay for it...

How you took the photo (accidentally, with a P&S) is irrelevant -- it's a great shot, and clearly others like it enough to want to pay you for it.

That said, whatever you do settle on, get it in writing! You should have a basic contract, or letter signed by you an the other guy involved, saying exactly what the company/site is allowed to do and what they are not. For example: "I promans give you EvilSiteOfDoom a non-exclusive, non-transferrable license to use my photo name or ID for a period of one year on name of website. You may not sell, copy, or distribute the photo beyond name of website." and so on...

Yeah, I need to get a basic contract written up... I am seriously doubting I want any exclusive licensing for them.

Wow, that's a great shot!

But surely you can't ethically (and depending on your contract perhaps legally) give "exclusive rights" when you've had it sitting there with a Creative Commons license for 5 months?

If they pay you for exclusive rights and then see the image somewhere else that that was obtained legally before you changed the license the person paying wouldn't be very impressed!

Is there any way of knowing that it isn't already in use?
