Default getting models permission to use image

hi

i took a pic at a public demo of dancing at a community centre. legally, do i require permmission to sell it for editorial use

[this question could be in a different situation] if the subject gives permission to freely use a digital image is it normal/proffessioal to give them [a] a print or [b] a useable digital image [c] rights to use the image.

i realize it would good to ask for permission even if not legally required.

this relates to the uk

thanks all
mark

Most likely you do. Check your local laws.

Selling for editorial use in a publication isn't commercial. Advertising is commercial. Is it going to be an ad?

Since the community center is open to the public, as it was a public event, you could technically sell it to a newspaper. But, while getting the names for the cutline info, it's always good Identify yourself and inform the couple why you shot their photo and what you are planning to do with it. It's always to followed good journalism practices and get the who, what, when , where and why's (5W's) before submitting any photo to a publication. It just makes you look more on the ball, instead of the editor asking, "Did you happen to get their names?" and then sheepishly replying "no". Always do as much work possible so that someone else doesn't have to take busy time out of their workload to follow up on yours. If you sell it for an ad, you'll need a model release signed.

If they ask for a picture, sometimes I'll email them a Low Res, but normally if they don't ask I won't bring it up. Because....if the newspaper publishes it, couple sees it and wants to purchase a photo, that's extra money to you. Make sure if it's a daily twice weekly or weekly paper. If it's a daily, they might not use it, as yesterday's news is old news. But weekly and twice weeklies don't worry so much about daily deadlines that normally a daily does.

Only if they buy them. You could give them some usage rights "just to be nice," but nice doesn't pay the bills.
