I like the second one best. Not sure why. It just "grabbed" me more...

I like the second one...

In the first, the tree and the right bench sort of fight for dominance, whereas in the second, the tree becomes more of a part of the background and doesn't confuse the eye.

Same with the tombstones in the first pic - the background is brighter and steals the attention from the dark foreground subject, while the second pic (partially) fixes that.

But, I like the style of processing on the first pic better, with a different composition/angle/etc it could look pretty awesome, and pretty creepy. Like, something as simple as taking a few steps away from the bench so both benches and the tree fit in the frame without overlapping each other.... Just my amateur insight, hope you don't mind the critique.

I like the first one. I think the darker tone better suits the mood of the photo. Depicts the lonliness of winter and or the cemetary.
I like the composition and angle of the shot. The fallen back piece could represent any number of things, especially in a graveyard. Fallen comrades etc. The eye is distracted from the bench somewhat by the tree but I don't think you should chop it down.
The tree is magnificent and worthy of a photo of it's own.
Altogether a nice shot. I like it.

I agree. The first pic had a better mood for me. I actually found that the background stole my attention more in the second pic. The big patches of blown out highlights on the stones and the tree seemed to stop my eye from getting back to the bench where the lines of the tree in the first one brought me back to it.
