If you want a new background, try one of the Flickr groups like Wallpapers and Backgrounds where photos added to the group can be automatically taken to live up to the blurb "... use this place to find a background you like, and put it on your computer..." (or do a search for images under a (cc) Creative Commons licence).

... really?

I mean, I'm all for photographers rights and all that but to this extent? Personally I'd be honoured (and am, a few people I know have done it) for someone to use my shots as their wallpaper.

There's no financial loss and if anything, more exposure (somewhat) for said shooter.

If it says "all rights reserved" that means "please don't use it without asking me". You could certainly contact the person who took a shot you like and, in most cases, they would probably be fine with you using it. If you ignore the stated copyright and just take without asking, they don't even get the benefit from the warm fuzzy feeling of knowing someone else loves their work.

There is no shortage of excellent images that are available free or just for the asking so I don't see that there is any good reason to break the licence under which others make their work available.

I'm with Wolf on this one. There's a reason copyright law is as strict as it is (and frankly I don't believe it's strict enough), and that is, quite simply, to protect the rights of the person(s) etc. who created a product (as defined by the pertinent law). The argument, "well it doesn't hurt anyone" or there's no financial loss, or however one chooses to phrase it, is the same one used to steal songs from musicians. Value isn't always measured monetarily, and by depriving someone of, as Wolf says, "the warm fuzzy feeling" one has effectively failed to pay due compensation for an item of value for which the currency is warm fuzzies. The transaction is so easy, too, and we've all got a bottomless wallet full of 'em!
