I am a new nikon d40 user and would like to know the best settings ans way to take fireworks? Do i need to use a tripod etc ? thankyou for any help

Yes, a tripod is pretty much essential unless you're good at holding the camera still for 2-3 seconds ;) Try reading the article at the DPS blog about shooting fireworks (http://digital-photography-school.com/blog/how-to-photograph-fireworks/) or reading through some of these threads:

Or a general search for fireworks will get you a few more resultsBasically, you'll want a low ISO, small aperture (large f/#), and slow shutter speed to get the trails of the fireworks. :)
