The key here is communication...that everyone knows what they are agreeing to.
I think you have your answer already...

Jim's point about being sued even with a contract comes down to "misrepresentation"...you really want to avoid that, it's just bad business anyways...

( you "could" get sued for "anything" regardless of contract. But if you are not up front with the client, then "misrepresentation" could/would be a valid point of contention)
