batch processing : landscape and portrait

hi! im new to using action on photoshop and im trying o put signatures on my photos by doing 2 actions 1 for portrait and 1 for landscape.

im wondering if theres a way to put watermarks/signature on the lower rights corner of my photos for both landscape and portrait with only 1 action.

i tried using 1 action for both but the mark on the portrait ends like this sample photo

i never worked out how to do orientation specific processing in CS3, haven't looking in CS4. i ended up sorting the output of one process into two separate directories and the appropriate action to each directory in turn.

probably would have to delve into the scripting API to get it sorted, recording an action through the UI seems incapable.
