If you want a new background, try one of the Flickr groups like Wallpapers and Backgrounds where photos added to the group can be automatically taken to live up to the blurb "... use this place to find a background you like, and put it on your computer..." (or do a search for images under a (cc) Creative Commons licence).

I mean, I'm all for photographers rights and all that but to this extent? Personally I'd be honoured (and am, a few people I know have done it) for someone to use my shots as their wallpaper.
There's no financial loss and if anything, more exposure (somewhat) for said shooter.
