If you found something in the EULA that's important, just say it instead of making veiled references.
From what I've read, it sounds like Adobe is going after the Flickr/Picasa market, with added editing functionality. There will still be a free version after the beta test, and a pay version for people who want more storage and editing capability.
edit: I read through the terms (which are surprisingly concise) and privacy pages. I didn't find anything untoward or shady.
